Dasuki Trial: Co-Defendant Admits Writing Statement Under Caution Before EFCC

 

 

Aminu Baba Kusa, the second defendant in the ongoing trial of former National Security Adviser, Colonel Sambo Dasuki (retd), on Friday admitted before the Federal Capital Territory High Court, Abuja, that he personally wrote and signed his extrajudicial statement while in the custody of the Economic and Financial Crimes Commission (EFCC).

 

 

Kusa made the admission during a trial-within-trial before Justice Charles O. Agbaza, convened to determine the admissibility of the statement after he alleged that it was obtained under duress, contrary to provisions of the Administration of Criminal Justice Act (ACJA), 2015.

 

 

Under cross-examination by the prosecution counsel, O.A. Atolagbe, Kusa acknowledged that he read and understood the cautionary words preceding the statement before writing it in the EFCC office. He also confirmed appending his signature to the document and stated that the contents of the statement were based on findings from a search conducted at his residence.

 

 

The prosecution further challenged Kusa’s claim that he was detained for 30 days by the EFCC between November 24 and December 24, 2015. Atolagbe pointed out that court records showed the defendant appeared before Justice Baba Yusuf on December 14, 15 and 18, 2015, during which he was granted bail and later released after fulfilling his bail conditions.

The cross-examination followed the examination-in-chief conducted by Kusa’s counsel and that of the third defendant’s counsel, Solomon Umoh, SAN.

 

 

Justice Agbaza subsequently adjourned the matter until July 3, 2026, for the continuation of the sub-trial.

 

 

Dasuki, Kusa, Acacia Holdings Limited and Reliance Referral Hospital Limited are being prosecuted by the EFCC on a 32-count charge bordering on criminal breach of trust and dishonesty involving the sum of N33.2 billion.
